A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. No one who violates the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of Free International City shall construct buildings, install structures or other facilities, change the form and quality of land, reclaim public waters, fell trees, gather soil and rocks, construct roads and conduct similar activities in an absolute conservation zone designated to protect the unique characteristics of the natural environment of Jeju-do, without the permission of the Governor;
Nevertheless, from March 2017 to June 29, 2018, the Defendant: (a) was designated as an absolute conservation area; (b) cut the ground and filled up the lower area with heavy equipment, such as digging machines, etc. while the said land was designated as an absolute conservation area; and (c) constructed 2-story concrete buildings with the size of 84 square meters, width of 14 meters, height of 88 meters; (d) installed 53.6m in width and height of 8m in size; and (e) installed structures by piling up a retaining wall with the size of 185m in height of 185m in size.
2. A person who intends to engage in development activities, such as construction of buildings or installation of structures in violation of the National Land Planning and Utilization Act shall obtain permission from the Special Metropolitan City Mayor, Metropolitan City Mayor, Metropolitan Autonomous City Mayor, or Special Self-Governing Province head of Si/Gun;
Nevertheless, from March 2017 to June 29, 2018, the Defendant constructed a 2-story concrete building with a size of 84 square meters, width of 14 meters, height of 85 square meters in the same manner as Paragraph 1 without permission, and installed a structure by piling up concrete with a size of 185 square meters in the same manner as Paragraph 1, from March 2017 to June 29, 2018.
3. Where a building, the total floor area of which does not exceed 100 square meters, is constructed, the Special Self-Governing City Mayor, a Special Self-Governing Province branch office, or the head of a Si/Gun/Gu shall do so in advance.
