Reasons
1. Basic facts
A. 1) On February 19, 1998, the Plaintiff and the Defendant filed a lawsuit claiming partition of co-owned property against the Defendant as to the land and building before subdivision under the Seoul District Court’s 97Gahap9724, the government support of the Seoul District Court. On February 19, 1998, the Plaintiff and the Defendant filed a lawsuit against the Defendant for partition of co-owned property on the land and building before subdivision under the separate sheet 1 and 535.85 square meters among the above sub-story factories, which were the land before subdivision, and 1,144.87 square meters of the above sub-story factories, which were the land before subdivision. The Plaintiff, after subdivision between the Plaintiff and the Defendant, divided the land as indicated in the separate sheet 3 and the above sub-story factories under the separate sheet 609.22 square meters of the above sub-story factories.
3) In addition, after the completion of conciliation, the Plaintiff and the Defendant: (a) each building listed in the separate sheet No. 4 on June 22, 2011, are the Plaintiff (hereinafter “Plaintiff-owned factory building”).
() The Defendant’s “factory building owned by the Defendant,” collectively, is the 1st floor of 726 square meters, 2nd floor 730.37 square meters, 169.28 square meters, 1st floor of 1st floor of 1st floor of 169.28 square meters, and 8.19 square meters of 1st floor of 1st floor of 1st floor of 1st floor of 3rd roof, outside of the block structure, on each land listed in the attached list 1 through 3.
(B) A co-owned property partition contract was concluded to be owned and the registration of ownership transfer was completed accordingly. (B) However, the title page and building register of each factory building owned by the original defendant is located on the ground of each of the lands listed in the separate sheet 1 and 2 as well as the land listed in the separate sheet 3 as owned by the defendant, which are owned by the plaintiff.
