A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On November 22, 2007, the Defendant issued a summary order of KRW 700,000 as a fine for a violation of the Road Traffic Act (drinking driving) in the leisure support of the Friwon method, and on January 23, 2008, a summary order of KRW 5 million as a fine for a violation of the Road Traffic Act (drinking driving) was issued on January 23, 2008.
1. On November 18, 2017, around 22:20, the Defendant driven a nived vehicle B with alcohol concentration of 0.139% in blood while under the influence of alcohol level from about 1km to the front road of the 1km-ro 116, Echeon-si, Echeon-si.
2. On November 26, 2017, the Defendant driven a B-to-pubed vehicle with approximately 30 meters alcohol concentration of 0.107% from the 30m section of blood alcohol level on the road front of the entrance of the Gacheon-si, Echeon-si, Gacheon-si, Gacheon-si, Gacheon-do.
Summary of Evidence

1. Statement on the circumstances of the driver at each driving school;
1. Application of Acts and subordinate statutes to inquiries, such as criminal history;
1. The provision of Article 148-2 (1) 1 and Article 44 (1) of the Road Traffic Act and the selection of imprisonment for a crime under the relevant provision of the Act;
1. The former part of Article 37 of the Criminal Act, and Articles 38 (1) 2 and 50 of the same Act, which aggravated concurrent crimes;
1. Articles 53 and 55 (1) 3 of the Criminal Act to mitigate small amount;

It is so decided as per Disposition by taking into account all the factors of sentencing under Article 51 of the Criminal Act, such as the time limit for sentencing under Article 62(1) of the Criminal Act, the number of drinking alcohol and driving distance, the frequency and degree of punishment for the same kind of crime, the age, sex, sex, environment, family, support relationship, etc.
