1. Fraud;

A. On June 7, 2012, the Defendant related to the successful bid bid shall subscribe the remainder after deducting the interest from the maximum amount within the limit of KRW 40 million from the 7th day of each month to the “six-day successful bid amount” under the name of the 21st unit of each month, which is paid as the advance payment for the month, and on August 7, 2012, the Defendant received KRW 25.85 million from December 8, 201 to August 7, 2012 by means of the same method, including, but not limited to, giving the victim a total of KRW 15.1 million from the victim, as indicated in the attached list of crimes (1).

However, the defendant did not have any income at the time, and there was a bond equivalent to KRW 70 million per month, and paid interest of KRW 4 million every month, and the amount that should be paid every month to other successful bidders than the above successful bidders has exceeded KRW 15 million.

Therefore, the defendant did not have the ability to pay the above-mentioned money with the payment received from another successful bidder. The defendant did not have the ability to pay the above-mentioned money with the payment received from the victim as the payment to the successful bidder who has subscribed the victim to the next successful bidder.

Nevertheless, the defendant deceivings the victim as above and acquired a total of KRW 15.1 million from the victim.

B. On March 20, 2012, the Defendant, at E stores located in Mineyang-si D, concluded a false statement to the effect that “If the Defendant borrowed KRW 30 million to the victim C, he/she shall pay the interest on KRW 8 per month for KRW 20 million, and the interest on KRW 10 million per month for KRW 10 million, and shall pay it within three months, and shall pay it within three months after deducting the amount equivalent to the interest on the same day from the victim.”
