1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. On September 18, 1989, the Plaintiff was appointed as a middle school teacher at the Jeju-do District Office of Education, the Plaintiff served as a teacher at C High School from March 1, 2008 to February 28, 2015.
B. On July 23, 2014, the Defendant requested a disciplinary decision against the Plaintiff to the General Disciplinary Committee on Public Educational Officials in Jeollabuk-do.
C. On September 22, 2014, the General Disciplinary Committee on Public Educational Officials in Jeollabuk-do decided on the Plaintiff’s disciplinary action on January 1, 201 for the following disciplinary grounds (hereinafter “instant disciplinary action”). On October 14, 2014, the Defendant rendered a disposition of reduction of salary for one month against the Plaintiff pursuant to Article 78(1) of the State Public Officials Act.
[Grounds for Disciplinary Action] Article 9 of the Guidelines for the Preparation and Management of School Records is deleted, so that the contents related to the extracurricular shall not be entered in any item of school life register in middle and high schools as the provisions related to the extracurricular entry are deleted.
However, the Plaintiff, as a teacher in charge of family curriculum (Chigh School D) from 2012 to 2013, had received education and training for school personnel related to the guidelines for school life records from Chigh School D during each year, but was unable to enter 79 items (45) in school life records. In 79 items of the program, there are 25 items of the competition name, award name, and 2 or more items of the program, which are the major items of the program for the program, and 52 items of the program can be judged to be substantially included in the program.
