1. All of the plaintiff's claims are dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Reasons

1. On May 18, 2010, the Land Trust Co., Ltd. (hereinafter “Korea Land Trust”) concluded a real estate disposal trust agreement with the truster and beneficiary as to each of the instant real estate listed in the separate sheet (hereinafter “each of the instant real estate”) on the basis of the facts. On May 18, 2010, the trust registration was completed with respect to each of the instant real estate on May 18, 2010.

Under the real estate disposal trust contract, Defendant New Heti shall trust each of the instant real estate to the land trust for the instant real estate, and the trustee shall accept it, and the trust proceeds shall enter into a real estate disposal trust agreement as follows in providing it to Defendant New Heti.

Article 6 (Disposal and Management of Trust Real Estate) A trustee shall dispose of trust real estate according to the disposal price, method and conditions deemed appropriate, and may, if he/she has agreed on the management affairs by the time of disposal, directly entrust the management affairs of the lease and the maintenance and management affairs of the lease to a third party appointed by the trustee.

The defendant New Heti, who is entrusted with a special agreement, concluded a real estate disposal trust contract with the trustee with respect to each of the real estate in this case, with a land trust for the trustee, a joint beneficiary of the first priority beneficiary, a limited liability company for the second priority beneficiary, a military mutual aid association for the second priority beneficiary, a joint beneficiary construction company for the third and fourth priority beneficiary, and a real estate disposal trust contract for the second priority beneficiary as follows.

Land trust with respect to Article 9 (Management of Trust Real Estate) shall perform only the duties of management of ownership of the subject matter of trust, and all the duties following the implementation of the project (such as the sale and actual management, etc. of trust real estate) shall be carried out under the responsibility of Defendant New Heaster, Plotnam Limited Liability Company, Type 200, Type 200, Type 300, Type 400, Type 400, and volume 40, volume 5
