피고인은 2014. 5. 22. 21:19경 성남시 중원구 성남동소재 성남지하상가 E동 만남의 광장에서 폭행 신고를 받고 현장에 출동한 피해자인 경찰관 C가 자초지정을 물어보자 “이 씹할 놈들아 빨리 와야지, 니 보지 같은 새끼야, 니 엄마 보지를 찢어 죽인다, 이 개새끼야, 경찰 씹 새끼들아, 니미 씹할 보지다, 개새끼야, 니 엄마 보지를 쫘 찍어 좌우로 벌린다, 이 씹 새끼들아”라는 욕설을 하여, 공연히 피해자를 모욕하였다.
