A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On June 13, 2015, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (hereinafter “Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes”) went through the “Ethical Research Institute” on the second floor of the D Building in Ansan-si (hereinafter “Ethical Research Institute”) with the victim F (F, 17 years of age) who is a juvenile in the same high school as himself/herself, who was attending a field of high school, and went through a female toilet, and then intrudes into a public toilet with a view to satisfy his/her own sexual desire by taking the victim’s cryle, following the victim’s cryp in order to cut off the appearance of the victim’s use into a female toilet.

2. 성폭력범죄의 처벌 등에 관한 특례법위반( 카메라 등 이용촬영) 피고 인은 위 1 항과 같은 일시, 장소에서 위 1 항과 같이 화장실에서 용변 보는 피해자의 모습을 촬영하기 위하여 피해자가 있는 용 변 칸 위 틈으로 카메라 촬영 기능을 켠 채 피고인이 소지한 HTC 휴대 전화기( 디자 이어 )를 들이밀어 성적 욕망 또는 수치심을 유발할 수 있는 용 변 보는 피해자의 신체를 피해 자의 의사에 반하여 촬영하려고 하였으나, 그 뜻을 이루지 못하고 미수에 그쳤다.
