The defendant shall be innocent.

The summary of the facts charged is the owner of A truck, and around 14:16 on February 11, 2006, the defendant B, with respect to his duties, was in violation of the restriction on operation by carrying a cargo of more than 44.29 tons of the total weight on the front of the new business site of the Korea Highway Corporation located 79 kilometers in Busan, Busan, and operating the said vehicle.

2. The Constitutional Court Decision 2008Hun-Ga17 dated July 30, 2009 rendered on the 2008Hun-Ga17 (former part of Article 325 of the Criminal Procedure Act) that each of the applicable provisions of this case loses its effect retroactively;
