A defendant shall be punished by imprisonment for one year.

1. The Defendant is a person who has violated the provisions on prohibition of driving a motor vehicle under the influence of alcohol two times or more by driving a motor vehicle under the influence of alcohol with a blood alcohol concentration of 0.156% on February 15, 2007 and with a blood alcohol concentration of 0.152% on August 10, 2010.

On April 23, 2012, the Defendant driven the said car under the influence of alcohol with approximately 2 km alcohol content of about 0.139%, from the night market near Ulsan-gu, Simsan-gu to the south apartment located in the same Dong without obtaining a driver’s license on April 23, 2012.

2. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes and the Road Traffic Act;
