피고인은 2012. 8. 27. 13:15경 제주시 건입동에 있는 “동문로터리 음악분수대” 화단 옆에서, 일행 3명과 함께 술을 마시던 중 사회복지법인 B 직원인 C 등으로부터 제지를 당하자 행패를 부린 후, 같은 날 13:20경 112신고를 받고 출동한 피해자인 제주동부경찰서 소속 경사 D에게 불특정 다수인이 있는 자리에서 “너 뭐여, 짭새새끼야, 꺼져, 개새끼들아, 좆만은 짭새새끼, 대가리 쪼사불라(쪼개버린다)” 라고 큰소리로 말하는 등 그때부터 같은 날 13:25경까지 약 5분간 공연히 피해자를 모욕하였다.
