Reasons
Punishment of the crime
The defendant is a person who operates C located in Si Heung-si and has overall control over the safety and health management of his employees.
A business owner shall, when he/she conducts his/her business, take measures necessary for the prevention of danger in places where workers might fall down at work, where sand, structures, etc. might collapse, where material objects might fall or fall, or where other hazards may occur due to natural disasters in the course of his/her work, and where workers might fall on the roof cover with weak materials, such as asbestos slate, lines, etc. for the prevention of danger, and in cases where there is a concern that workers might fall on the roof covering the robbery with weak materials, such as radiation slate, wires, etc., the business owner shall take measures necessary for the prevention of danger, such as installing a light board at least 30cm in width, or using a safety watch, etc., and shall ensure that workers engaged in work at a place where a height of at least two meters might fall, wear a safety cap and safety belt.
Nevertheless, around 10:04 on August 18, 2016, the Defendant: (a) had the Victim F (35 years of age) and G (39 years of age) (hereinafter “F”) who is an employee of C in Sinsi E located in Sinsi, and the Defendant did not take measures, such as installing a shot board on the roof of the Panel in which robbery was weak; (b) did not take measures to ensure that the said employee, who performs the construction of electric wires on the roof of the Panel of the Stacking Room Stacking Room with a height of at least 3 meters, paid the safety caps and safety belts to the said employee, and did not take measures to wear the safety caps and safety belts; and accordingly, the above employee fell into the floor with the roof of the panel, and accordingly, the victim F caused the death of the brain at the I Hospital located in Sinsi during treatment at around 03:30 on August 21, 2016.
