1. The Defendants, as to each of the lands listed in the separate sheet from the Plaintiffs, are supported by Suwon District Court.
Reasons
1. The facts under the recognition are found to be in accordance with the respective descriptions of Gap evidence 1 to 5, 7, and 8 (including, if any, branch numbers; hereinafter the same shall apply) and the purport of the whole pleadings, either as a matter of dispute between the parties or as a whole.
A. On April 21, 2008, the Plaintiffs entered into a contract with the Defendants on April 21, 2008 to purchase 150 million square meters in total of 694 square meters and 1984 square meters in total (600 square meters in total) among the 10,711 square meters in common with other punished agents, G and H, which are co-owned by the Defendants, for the purpose of using as a site for electric source housing. The Plaintiffs paid 30 million won in down payment and intermediate payment of 50 million won in total and 80 million won in total to the Defendants by May 13, 2008.
B. On September 2, 2009, 1,290 square meters of I forest is divided into 5,687 square meters of I forest, J forest 2,677 square meters, and 2,347 square meters of K forest. Among them, 2,347 square meters of K forest is divided into 1,653 square meters of K forest and 694 square meters of L forest and 694 square meters (attached Table 1; hereinafter “1”) on November 16, 2009, the part of “694 square meters of I forest and 694 square meters of land” purchased by the Plaintiffs became land 1.
The land No. 1 was owned by Defendant D, G, and H respectively due to the partition of co-owned property on September 28, 2009.
C. On August 23, 2010, the Plaintiffs agreed with the Defendants to sell 92 square meters of F forest 1290 square meters to a third party. On August 23, 2010, the Defendants agreed with the Defendants to convert the subject of sale into 298 square meters of land and F forest 1,290 square meters of land and F forest 1,290 square meters (30 square meters), and to adjust the price to KRW 75 million (hereinafter “the revised agreement”). The Defendants agreed to pay the Plaintiffs the difference between the above price of KRW 75 million and the price of KRW 80 million, which is five million of the price already received, to KRW 25 million, and KRW 30 million in total.
The Defendants sell 92 square meters among F forest land 1,290 square meters to M on November 201, 2010, and each share of 496/1,290 among the above land is added.
