A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2018 Highest 2274] The defendant was in a relationship with the victim B (n, 60 years of age), but he was in a relationship with the victim C (24 years of age). The victim C (24 years of age) is the son of the above B.

1. 2. 2018. 8. 8.경 범행 피고인은 2018. 8. 8. 18:50경 전항 기재 피해자 B의 주거지에 이르러, 피해자 B와 사귈 때 건네받았던 주거지 대문 열쇠를 그대로 소지하고 있던 것을 기화로 피해자의 허락 없이 위 열쇠를 이용하여 대문을 연 다음 피해자가 거주하는 2층 계단까지 들어가 피해자의 주거에 침입하였다.

Accordingly, the defendant invadedd the victim B's residence.

3. On August 13, 2018, the Defendant committed the crime: (a) around 22:00 on August 13, 2018, at the front of the entrance of the victim as stated in the preceding port prior to the entrance; (b) opened the entrance door and attempted to intrude into the victim’s residence; (c) however, the entrance was not opened at the wind not opened due to the correction of the entrance.

Accordingly, the defendant attempted to intrude the victim's residence, but did not bring about such intention, but did not commit an attempted crime.

[2018 Highest 2938] The Defendant had a relationship with the victim B (n, 60) for about 10 years, but was a relationship with the firstman on June 2018.

1. On September 23, 2018, the Defendant: (a) around 06:18, at the victim’s residence located in Daegu Seo-gu D, and opened a door in Seodaemun-gu.
