Reasons
Punishment of the crime
[criminal power] On April 17, 2012, the Defendant was sentenced to imprisonment for one year with labor for a violation of the Road Traffic Act (driving) in the Gunsan Branch of the Jeonju District Court on April 17, 2012, and was sentenced to six months of imprisonment with labor for the same crime at the Jeonju District Court on August 13, 2014, and completed the execution of the sentence on November 28, 2014.
On June 20, 2018, the Defendant was sentenced to imprisonment with prison labor for a violation of the Road Traffic Act (refluence of the measurement of noise level) in the Jeonju District Court’s military mountain support on June 20, 2018, and the said judgment became final and conclusive on June 28,
【Criminal Facts】
1. Around 05:55 on February 19, 2017, the Defendant was driving a DK5 vehicle under the influence of alcohol content of 0.091% without obtaining a driver’s license in the section of approximately 6 km from an insular road, which does not exceed 05:5 to the front road in C in the same city.
Accordingly, the Defendant, who violated the prohibition of driving under the influence of alcohol not less than twice, was driving a motor vehicle under the influence of alcohol in violation of this provision, and simultaneously driving a motor vehicle without a driver's license.
2. The Defendant was found to have driven alcohol at the time and place specified in the above paragraph (1) and was asked to present his identification card from F to the police box belonging to the Kim Jong-gu Police Station.
At the time, the defendant had escaped due to the designated number of times, and the official document was presented to the above F as if he was the driver's license of the defendant, which was issued by the director of the Busan Local Police Agency.
3. The Defendant, at around 07:00 on the same day, signed the “G” by using a black camera in the name column of voluntary movement agreement and the statement of the circumstances of the principal and the driver, presented by the E box located in Kim Jong-si, Kim Jong-si on the same day.
