피고인은 2018. 10. 31. 12:00경 서울 송파구 B에 있는 C교회 앞 사거리에서 D 쏘나타 차량을 운행하던 중 피해자 E(여, 27세)이 운행하는 F SM3 차량과 충돌하여 교통사고가 발생하자 다수의 행인과 차량 운전자들이 있는 가운데 피해자에게 "미친년, 씨발 년아 어디 여자가 운전을 그 따위로 하냐, 야 개같은 년아, 새파랗게 어린게 미쳤냐, 운전하지 말아라, 눈은 뜨고 다니냐, 눈은 어디다 뒀냐, 차 끌고 나오고 싶지 않게 해줄까"라고 욕설하여 공연히 피해자를 모욕하였다.
