피고인은 2013. 3. 18. 05:10경 의정부시 F에 있는 G사우나 앞길에서 C과 함께 담배를 피우며 이야기를 나누던 중 마침 그곳을 지나가던 피해자 H(44세)를 보게 되자 아무런 이유 없이 피해자를 따라가 붙잡은 후, 피고인은 주먹으로 피해자의 얼굴, 머리를 수회 때리고 발로 피해자의 배를 수회 걷어차고, C은 주먹과 발로 피해자의 온몸을 수회 때리고 찼고, 피해자가 경찰에 신고를 하겠다며 피고인과 C을 따라 오다가 다시 도망을 가자 2 ~ 30m 가량 추격하여 위 I에 있는 J고등학교 앞길에 이르러 피해자를 다시 붙잡은 후 피고인은 주먹으로 피해자의 얼굴, 머리, 등을 수회 때리고 발로 배를 수회 걷어차고 C은 주먹과 발로 피해자의 온몸을 수회 때리고 찼으며, 피해자가 계속하여 위 가능동에 있는 가능역 2번 출구로 뒤따라오자 다시 피해자를 붙잡아 피고인은 주먹으로 피해자의 얼굴을 수회 때리고 발로 피해자의 배를 수회 걷어차고 C은 근처 제과점 앞에 있던 플라스틱 상자를 집어 들어 피해자의 얼굴을 수회 내리쳤다.
