The defendant shall be innocent.

1. In the facts charged, the Defendant is a director of the E Co., Ltd. in Seocho-gu, Seocho-gu.

On July 20, 2013, at the office located on the 6th floor of the Gangnam-gu Seoul F building, the Defendant: (a) purchased stocks of the EF corporation to the effect that “The Defendant purchased stocks of the EF corporation from February 2014, by converting H’s non-listed stocks into a mass production system; (b) distributed class 4 of hub 4 in large Mart and 24 Simart to a mass production system; and (c) intended to attract agents to list into the KOSDAQ by inviting agents; and (d) 100 of the steel frame content in Mongolia and its tourists to create the hubme, and to maximize tourist profits by attracting them into one-day course on October 2014, 2014.”

However, the Defendant had a debt equivalent to KRW 2.7 billion at the time of operating the above E, and there was no economic situation, such as the failure to pay taxes equivalent to KRW 200 million, and thus, there was no way to list the unlisted stocks on the KOSDAQ while carrying out the above business, and there was no intention or ability to return the purchase price for the unlisted stocks issued by the injured party.

The Defendant, by deceiving the victim as such, received 32 million won from the victim under the name of the purchase price of shares on the same day.

The defendant, as stated in the list of crimes attached to the same day on the same day, deceiving the total of eight victims, and receive a total of KRW 74.4 million from the victims.

2. Determination

A. The gist of the Defendant and his defense counsel’s assertion was to secure investment funds by selling shares of the company in cooperation with I to resolve the financial difficulties due to financial difficulties of the Defendant and his defense counsel, and to request I to sell shares.

However, the defendant is at the time and place stated in the facts charged.
