1. The judgment of the first instance court, including the claims extended and reduced in this court, shall be modified as follows:
Reasons
1. Basic facts
A. Status 1 of the parties) The Plaintiff is Seocho-gu Seoul Metropolitan Government A Apartment (hereinafter “instant apartment”).
(2) Defendant B is a project proprietor who constructed and sold the instant apartment, and Defendant B is the Intervenor D Co., Ltd., E Co., Ltd., and F Co., Ltd. (hereinafter collectively referred to as the “Supplementary Intervenor”) under a contract with the Defendant, and the Defendant C Co., Ltd. (hereinafter collectively referred to as the “Defendant Intervenor”) performed construction of the instant apartment, construction of the instant apartment, construction of the elevator, and construction of the elevator among them. The Defendant C Co., Ltd has guaranteed the obligation to repair the defects of the Defendant D’s apartment in the instant apartment.
B. Of 482 households, 320 households (G Dong, Hdong, I consent 1 through 3, Jdong, and Kdong) among the 482 households as a mixed housing complex where the instant apartment house for the purpose of sale and rental housing are located. The remaining 162 households are leased households. The instant apartment house was approved for use on June 24, 2014.
On October 31, 2014, the Intervenor D entered into each contract for the repair of defects (hereinafter “instant repair of defects”) with respect to the selling household among the apartment units of the instant case with the Defendant Cooperative and the instant apartment units, and received each written contract for the repair of defects as described below.
Since then, the guarantee creditor under the instant warranty contract was changed to the Plaintiff.
