A defendant shall be punished by imprisonment for three years.
Reasons
Punishment of the crime
On November 11, 2008, the Defendant was sentenced to imprisonment with prison labor for larceny, etc. on April 23, 2009; imprisonment with prison labor for one year and six months; imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes; and imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes in the same court on March 16, 2012; and on February 5, 2014, the Defendant completed the execution of the said final sentence in the Net Prison.
1. On October 8, 2014, the Defendant committed the crime against the Victim C and the Victim Nonghyup Bank: (a) discovered the fact that the Defendant was parked in a vehicle with the window of E.S. and E. and E.S. in the name of E. and E.S., which was kept in custody between E.S. and E., entered the vehicle through the window; and (b) cut off one head of E.C. in the name of E., who was in custody between E.S. and the chief of E.M.
On October 9, 2014, at around 05:18, the Defendant continuously posted a stolen passbook in the name of the Defendant, as seen above, and then withdrawn KRW 5,660,000 through six times, after entering the password in the passbook.
2. At around 01:00 on January 8, 2015, the Defendant committed the crime against the Victim F and the Victim NongHyup Bank: (a) cut off one copy of the NongHy Card kept in the Victim F and the Defendant’s cell phone case using a cresh in the victim’s cell line.
The Defendant continued to put the F F F F F’s Cze Card into a cash withdrawal machine managed by the Victim Nonghyup Bank, which was established in a non-defluence lower than Si, and then, then entered the Cze Card password, which was known to the Defendant, and then withdrawn KRW 300,000 in cash and stolen it.
