1. The Defendant (Counterclaim Plaintiff) paid KRW 750,000,000 to the Plaintiff (Counterclaim Defendant) and its related amount from October 29, 2015 to February 5, 2016.
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Facts of recognition;
A. The relationship between the parties 1) C Regional Housing Association (hereinafter “Association”)
(2) The Plaintiff is a real estate agent operating the F Licensed Real Estate Agent Office from December 2, 2005, and G is a real estate agent operating the H Licensed Real Estate Agent Office in Ulsan-gu. The Plaintiff is a real estate agent operating the business site, which is a real estate rental business and sales business, and the Defendant purchased the land within the business site with the association. (2) The Plaintiff is a real estate agent operating the Ulsan-gu E-Gu, Ulsan-gu, and building on land (hereinafter “instant real estate”).
B. The Plaintiff’s land purchase 1) On December 13, 2014, the Korea-U.S. Construction Technology Group concluded a service contract on behalf of the Plaintiff for the purchase of land for the project site in U.S., U.S., U.S., U.S. and U.S., U.S., on behalf of the Plaintiff. The Plaintiff and G were re-entrusted with the purchase of land by the Korea-U.S. Construction Technology Group in the project site. (2) On January 2015, the Plaintiff and G arranged the purchase contract for J, K, L, M, and U.S. E. E. F&D.
3) On April 7, 2015, the Plaintiff and G terminated an agreement with the Korea Construction Technology Foundation, which did not pay the down payment on the agreed date, and entered into a service contract on behalf of the Plaintiff and G for the purchase of land on the project site in Seodo Construction Co., Ltd. and Ulsan-gu D Northbuk-gu. (4) around April 2015, the Plaintiff and G arranged a sales contract for N,O, P, Q, and anti-do Construction Co., Ltd., a landowner in the project site.
C. On July 7, 2015, the Plaintiff sent text messages to Defendant R as follows.
There is no liaison with the R President, and there is no liaison.
