1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The C Village residents, including the Defendant, purchased nearby forests and fields as a D Housing Site Development Zone, and the housing site was developed as a housing complex, and the road and village hall site were shared according to their respective equity ratios.

B. On the ground of a partition of co-owned property pursuant to a final judgment on March 15, 2001, the Defendant completed the registration of ownership transfer as to E forest land E 1,050 square meters (hereinafter “the instant housing site”), which is a housing site, on the sole ground of the partition of co-owned property pursuant to the final judgment on March 15, 2001. As to F forest land which is a road and community hall site site, 310 square meters, and G forest land 4,08 square meters, respectively

C. On May 17, 2001, the Plaintiff paid KRW 60 million to the Defendant, but received a return of KRW 10 million on October 9, 2001.

On May 10, 2002, the defendant completed the registration of partial transfer of ownership on March 15, 2002 with respect to 331/1,050 shares in the housing site of this case to the plaintiff on May 10, 202.

E. On March 11, 2003, F forest land was converted into 310 square meters of H forest land, and was divided into 298 square meters of H forest and 12 square meters of I forest. The land category of H forest and 298 square meters was changed to a site.

F. HJ large 298 square meters were 298 square meters for the change of the name of the administrative district on October 31, 2005.

G. On March 11, 2003, the land category of I forest land was changed to a road. On October 31, 2005, the land category was changed to 12 square meters.

H. On March 11, 2003, G forest land 4,088 square meters was divided into J forest land 4,033 square meters and K forest 55 square meters. The land category of J forest 4,03 square meters was changed to a road.

B. On October 31, 2005, J-road 4,03 square meters was divided into J-road 3,825 square meters and L road 208 square meters on May 22, 2009.

B. On April 14, 2011, J-road 3,825 square meters was divided into 3,664 square meters and M-road 161 square meters.

C. On May 4, 2011, J-road 3,664 square meters was divided into 3,550 square meters and 52 square meters and 62 square meters and 0-road.

(l) K forest land of 55 square meters shall be on March 11, 2003.
