1. The defendant shall be the plaintiff.
(a) deliver the real estate listed in the separate sheet;
B. From 5,500,000 won and from 23, 2020.
Reasons
According to Gap evidence Nos. 1 through 4, the plaintiff entered into a lease agreement with the defendant on February 23, 2019 on the attached list owned by the plaintiff, 5 million won per month, and 800,000 won per month, and received 2.5 million won from the defendant, and the defendant delayed the rent from April 18, 2019, and the plaintiff notified the defendant of the termination of the lease agreement on September 18, 2019, and the defendant paid the rent by 80,000 won each over 10 times from September 30, 2019.
According to the above facts, since the lease contract on the real estate stated in the attached list was lawfully terminated by the notice of termination on the ground of delinquency in rent, the defendant shall deliver the real estate stated in the attached list to the plaintiff, and pay 5 million won calculated by deducting 2.5 million won from the total rent of 8 million won from February 23, 2020 to December 22, 2020 the amount of deposit of 2.5 million won and 8 million won per month from December 23, 2020 to the delivery date of the real estate stated in the attached list.
The plaintiff's claim is justified, and it is so decided as per Disposition.
