Reasons
The grounds of appeal are examined.
1. Examining the reasoning of the lower judgment on the grounds of Defendant A’s appeal in light of the evidence duly admitted, the lower court, based on the following circumstances: Defendant A, Defendant B, Defendant B, and C, etc., as indicated in its reasoning, assisted the purchase of sex by child and juvenile as a business, on the grounds that: (a) the process and purpose of soliciting and arranging sexual traffic; (b) the background and method of inducing and arranging sexual traffic; (c) the scale and sharing of roles in the process of inducing
Based on the judgment of the court below, it is just to determine the defendant guilty of violating the Act on the Protection of Juveniles from Sexual Abuse (hereinafter “Juvenile Protection Act”), and there is no error in the misapprehension of the legal principles on “business” under Article 15(1)2 of the Juvenile Sex Protection Act.
In addition, pursuant to Article 383 subparagraph 4 of the Criminal Procedure Act, only in cases where death penalty, life imprisonment, or imprisonment with or without prison labor for not less than ten years is imposed, an appeal is permitted based on unfair grounds for sentencing. Thus, the argument that the determination of punishment is unfair is not a legitimate ground for appeal in this case where the above defendant was sentenced to minor punishment.
2. Examining the reasoning of the lower judgment as to Defendant D and E’s grounds for appeal in light of the evidence duly admitted, the lower court, based on the circumstances indicated in its reasoning, found Defendant D and E as a child juvenile subject to sexual purchase at least dolusent recognition and purchase.
Therefore, the judgment of conviction against the above Defendants is just, and there is no error of exceeding the bounds of the principle of free evaluation of evidence in violation of logical and empirical rules, or of misapprehending the legal principles on the purchase of sex or intentional act under Article 13(1) of the Juvenile Sex Protection Act.
3. As to the grounds of appeal by Defendant F, the lower judgment.
