A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant, using his resident registration certificate in the forged name D, provided D real estate as security, and conspired to borrow KRW 700 million from E from the victim, who is an accomplice (the suspension of indictment due to the unknown whereabouts of the location). A.
On June 10, 2013, at the office of "G" located in Seocho-gu Seoul Metropolitan Government, the Defendant forged a private document forgery 1) around 13:00, the Defendant stated the column for indication of the loan agreement to indicate and guarantee the real estate provided by the accomplices in the document title "G" located in Seocho-gu Seoul Metropolitan Government, and stated "D", "H", "H 7 Dong 1206," and "J" in the resident registration number column and the contact column in the document title. On June 10, 2013, the Defendant stated in the document title "B" located in "B" office in Seocho-gu Seoul Metropolitan Government, and stated in the second interruption column of the above document as "D", "H", "H resident registration number" and "H", and affixed a seal in advance.
Accordingly, the defendant, in collusion with C, has forged one copy of the letter of consent on the provision of real estate in the name of D, which is a private document with respect to rights and obligations, and one copy of the loan transaction agreement.
B. At the above time and place in collusion with C, the Defendant held each of the above investigation documents with D’s certificate of personal seal impression, certificate of right to registration, etc. as if he/she knew of the above facts, each of the above written consent on the provision of forged real estate security and one copy of the loan transaction agreement.
C. The Defendant, in collusion with C, committed as if he were D with a forged resident registration certificate, and offered K and 10 parcels as security, such as the foregoing A and B.
