피고인은 2013. 9. 22.경 양산시 C에 있는 D 종무실에서 위 사찰 신도회장 E 등 10여명의 신도가 듣는 가운데 위 사찰의 주지인 피해자 F을 지칭하면서 “스님이 전부 거짓말을 하고 있다, 사기꾼이다, 땡중이다”라고 말하여 공연히 피해자를 모욕하였다.
