1. The Defendant: (a) against Plaintiff A, KRW 35,619,578, and KRW 17,347,919 for each of the said KRW 17,347,919 for each of the said KRW and each of the said KRWs.
Reasons
1. Facts which have no dispute (based on recognition), Gap evidence 1, 3 (including provisional number; hereinafter the same shall apply), Eul evidence 1, and the purport of the whole pleadings;
A. The relevant Defendant is a juristic person operating Jongno-gu Seoul Metropolitan ED Hospital (hereinafter “Defendant hospital”), and is the medical staff of the said hospital. The Plaintiffs are the successors of the deceased (Plaintiff A) and his/her children (Plaintiff B and C) (hereinafter “the deceased”), who died on July 9, 2013 after having received kidne surgery at the Defendant hospital on June 27, 2013, as seen thereafter.
B. In July 1989, the Deceased, who was the Gsking Gsking Gsking, was diagnosed with the hythrosis due to the immunologic tyrosis and received hyrosis surgery. Around 2008, the Deceased started blood salvine due to chronic transplantation due to chronic transplantation, and around December 10, 2002, the Deceased was under use of the hyrosis surgery due to the salvine disease in the hyroid. The Deceased was under use of the hyroid surgery, DNA salphine, blood salphical salphine, and hyrosis and high-tension surgery.
C. On June 27, 2013, the Deceased Nos. 1 and 2 surgery of this case (hereinafter “the first surgery”) was conducted on June 27, 2013.
(2) In the process of the first operation of this case, the anesthesia and the medical personnel of the Defendant hospital inserted the food and body temperature to the deceased. Upon the deceased’s blood transfusion from the mouth, the Defendant hospital suspected of blood transfusion and applied Bosscopics to the deceased, and applied Boscopscopics to the blood transfusion.
3) However, after the first operation of the deceased, the blood transfusion in the mouth of the deceased continued. Accordingly, the medical team at the Defendant Hospital maintained the engine insertion of the deceased and taken measures to transfer the deceased to the hospital room, and when the blood transfusion was observed through the mouth from the mouth and the mouth of the deceased, the blood transfusion was performed. 4) The above measures were taken within the mouth of the deceased.
