Text
1. The defendant shall be the plaintiff.
(a) Ordering a section (A) of 45 square meters on board that connects each point of the attached Form 1, 2, 3, 4, and 1 among the real estate listed in the attached list among the real estate in the attached list;
B. From August 15, 2017, to the completion date of the above order, money shall be paid at the rate of 350,000 won per month.
2. The costs of the lawsuit are assessed against the defendant.
3. Paragraph 1 can be provisionally executed.

1. Status of the parties
(1) On July 22, 2016, pursuant to Article 11(1) and (2) of the Housing Act, the Plaintiff Union has obtained authorization to establish a housing association from the head of the Dong-gu Busan Metropolitan City (Evidence A1-1) by securing at least 80% of the housing construction site.
On December 29, 2016, the Plaintiff Union obtained a revised authorization for the addition of its members, and the number of its members is 486.486 (Evidence A 1-2).
On June 15, 2017, the Plaintiff Union acquired the ownership of at least 95% of the current housing construction site, completed the registration of transfer, and completed the application for approval of the project plan to the head of the Dong-gu Busan Metropolitan City Office on June 15, 2017, and it is anticipated that the approval of the project plan will be made on November 1, 2017.
(2) The Defendant has the capacity to lease some of the first floor of the building indicated in the attached list included in the instant housing construction site.
2. 이 사건 부동산의 매먜 등 부분
(1) On March 31, 2017, the Plaintiff purchased the land located in the project site in Busan Dong-gu, Busan and the land of 153 square meters and the land of this land (attached Form).
The Act on the Registration of Ownership Ownership D and Sales Contracts were concluded, and 450 million won was paid, and the registration of ownership transfer was completed on May 25, 2017.

에 대하여 보증금 500만원에 월차임 35만원으로 하고, 임대차기간을 24개 웒로 하는 임대차계약올 체결하였고. 피고는 2014. 4. 30.부터 현재까지 이곳에 거주하고 있습니다.
(3) 원고는 피고를 포함한 이 사건 사업부지에 포함된 건물에 거주하는 거주자들에게 '이주 일정과 관련한 협의를 위해서 조합사무실을 방문해 달라'고 여러 차례 연락하였고, 이에 피고는 '2017. 5. 2. 이주하겠다'고 하뎠으며, 원고는 피고에게 2017. 5. 1. 보증금 500만원을 지급하였습니다.
(4) However, since the defendant did not comply with the above emigration commitments, the plaintiff did not comply with the defendant.
6. 초경 '8월말까지 이주해 달라,는 내용의 내용증명을 발송했고, 2017. 8. 4. 피고 등에게 '8월 15일부터 뭘세률 조합에서 받겠다. 이주에 관하여 원만한협조를 당부드린다'는 내용의 내용증명을 재차 발송하였습니다.
3. Conclusion
그럼에도 불구하고, 피고는 이주 약속을 위반하였을 뿐만 아니라, 아직 이주 일정을 밝히지도 않고 있으며, 원고와의 이주 협의에도 응하지 않고 있으므로,원고는 부득이하게 건믈명도 등을 청구하기에 이른 것입니다.
