1. The defendant shall be the plaintiff.

(a) Of the land size of 858 square meters in Pakistan-si, each of the indication 1, 2, 48, 49, 50, 51, 52, 14, 15, and 1 of the attached Form 1 drawings.

Reasons

1. Facts of recognition;

A. On May 10, 2017, the Plaintiff purchased a 858 square meters (hereinafter “instant clan land”) from the D clan (hereinafter “Nonindicted clan”) and completed the registration of the transfer of ownership on June 23, 2017.

2. Determination

A. According to the above facts of determination as to the cause of the claim, the Defendant is obligated to remove the instant housing, etc. and deliver the instant land to the Plaintiff, unless the Defendant asserts and fails to prove the source of right to possess the instant land, including the site of the instant housing.

B. The defendant asserted the right to purchase the ground property 1 in the judgment of the defendant's argument, the defendant purchased the house of this case and succeeded to the land lease agreement with the non-party clan in 1974 to 5, and thereafter, the plaintiff who purchased the land of this case seeks to terminate the above land lease agreement, and therefore, he asserts that he exercises the right to purchase the ground property under Article 643
