1. The defendant is paid KRW 5 million from the plaintiff, and at the same time, among the first floor of the building listed in the attached Table 1 to the plaintiff.
Reasons
1. Comprehensively taking account of the overall purport of pleadings as to the statements in Gap evidence Nos. 1 through 4, Eul evidence Nos. 1 and 2: ① The plaintiff is a housing redevelopment and rearrangement project association with one project district in Mapo-gu Seoul Mapo-gu; ② With respect to a housing redevelopment project implemented by the plaintiff by the head of Mapo-gu Seoul Metropolitan Government, the approval of a management and disposal plan on December 8, 2014 and the notification thereof on March 12, 2015; ③ the defendant entered into a lease agreement with Eul on March 21, 2015 with regard to real estate located in the order of the plaintiff's business district (hereinafter "real estate of this case"), and the fact that the real estate of this case is occupied and used at the same time by paying the above deposit and the rent to D until January 2016, barring any special circumstance, the defendant is obligated to deliver the real estate of this case from the plaintiff to the plaintiff during the period from March 21, 2015 (hereinafter "the real estate of this case").
2. The defendant asserts that the transfer cost, etc. of movables should also be paid. However, the defendant has the right to receive the transfer cost, etc. of movables.
In light of the fact that the purpose of recognition is not to compensate for the loss suffered by the owner due to the implementation of the project, but to be paid at the level of social security, the obligation to pay is a preferential performance relationship than the defendant's obligation to deliver the real estate of this case.
The defendant's above assertion is without merit, since it cannot be seen as having a simultaneous performance relationship.
3. If so, the plaintiff's claim of this case is accepted within the scope of the above recognition, and the remainder is dismissed as it is without merit. It is so decided as per Disposition.
