3. 공무집행방해 피고인은 2012. 03. 28. 21:00경 마산동부경찰서 F파출소에서, 피고인이 I을 폭행한 문제로 F파출소로부터 출석하라는 연락을 받고 F파출소에 도착하여 "신고자를 찾아 왔다."며 F파출소에서 고함을 지르고 "나를 신고한 사람 어디 있냐 이씨발놈들아 나를 신고한 사람 오라케라" 하며 고함을 지르며 소란을 피우고 파출소에서 담배를 꺼내어 피우려고 하는 것을 F파출소 경사 J가 이를 만류하여 밖으로 나가 흡연할 것을 요구하자 경사 J의 멱살을 잡아 흔들고 왼손을 잡아 꺾는 등 폭행하고, 이를 말리는 경찰관 K에게 30분간에 걸쳐 "야이 십새끼야 내가누구인지 아냐, 좃대로 해라. 십새끼들아 너 경찰들 똑 같은 놈이다. 다죽인다 개새끼들"이라고 협박을 하여 경찰관의 정당한 직무집행을 방해하였다....
