1. The plaintiff's claims against the defendants are all dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Basic Facts

The Plaintiff obtained permission for conversion of mountainous district from Hadong-gun to December 30, 2014 for the purpose of building a factory with respect to 29,670 square meters out of total 30,670 square meters of 30,670 square meters in Hadong-gun, Chungcheongnam-dong-gun (hereinafter “instant mountainous district”) around February 2, 2014, from February 11, 2014 to December 30, 2014.

(The foregoing permission was extended two times by December 30, 2015, and until December 30, 2016). From October 20, 2014 to November 2, 2015, DefendantHadong-gun issued an order to restore the original site to the original plan (FH26) or remove soil and rocks, in violation of the project plan (site creation) and the Plaintiff’s original plan (FH26) from October 2, 2015; if the Plaintiff illegally damaged the site width of the site approved by the second part (FH35) site and committed an illegal act that steals and remove soil and rocks, it ordered the Plaintiff to restore the original site of this private road to the original state, suspend the removal of soil and rocks, etc. by sending official notices as follows to the Plaintiff:

(1) Where the Plaintiff, in violation of the first project plan (site creation), submitted a temporary order to temporarily suspend the reinstatement of earth or stone to the original plan (FH 26) and to temporarily suspend the restoration of the earth or stone to the original plan (from October 24, 2014 to the original plan) on October 20, 2014, including: (a) orders to suspend the removal of earth or stone; and (b) orders to temporarily suspend the restoration of the earth or stone (from October 31, 2014 to October 31, 2014) pursuant to Article 20(1) of the Mountainous Districts Management Act; and (c) orders to temporarily suspend the restoration of the earth or stone to the original plan (from October 24, 2014 to October 31, 2014): (d) orders to temporarily suspend the restoration of the earth or stone to the original plan within the period of 30/14th of December 214, 2014; (e) orders to temporarily suspend the restoration of the mountainous district to the original plan.
