1. The plaintiff's claim is dismissed.

The following facts may be acknowledged either as a dispute between the parties or as to Gap evidence Nos. 1, 7, 3-1, 3, 6-1 through 6, 2-1, 6-2, 6-3, 7, 8, 10, 11, 7-4, 5, 8-1 through 4 of the evidence Nos. 7-4, 8, 8, 10, 11, 7-1, 8-1 through 7-4, and 8-1 through 8 of the evidence Nos. 8, and the whole purport of the pleadings in relation to the testimony of the witness and the fact-finding to the Governor of Gangwon-do

On July 17, 1974, the area of 2,043 square meters prior to the division was divided into 1,293 square meters prior to the Hongcheon-gun, Hongcheon-do (hereinafter “instant land”) and 750 square meters prior to the Gangwon-do Hongcheon-gun E road (the same day is changed to a road).

B. On February 4, 1975, the defendant completed the registration of ownership transfer concerning E roads, and currently uses E roads as part of Do road Fho Lake Line.

(Do road Fho line was designated on October 9, 1995). (C) The route was designated on October 9, 1995.

On April 1, 2009, the Plaintiff completed the registration of ownership transfer on the instant land.

Before the Plaintiff acquired ownership of the land of this case, cement and asphalt packaging is being constructed on the ground of the part of 83 square meters in the ship (hereinafter “the part of the instant dispute”) which had been connected in sequence with each point of 1, 2, 3, 4, and 1 attached Form 1, which is part of the instant land, and the shape on which the dispute of this case was packed is as shown in attached Form 2.

E. The instant land and the instant dispute are located immediately adjacent to the E road.

F. The instant land is used as the access roads to and entry into roads and neighboring land by neighboring residents, and the instant dispute part is the only passage connected to local highway F lines, such as the attached Form 3 video description.

G. Before acquiring the land of this case, the Defendant packaged part of the dispute of this case at the request of the residents using the access roads of the E-road and the access roads of the neighboring land.
