1. The defendant shall be punished by imprisonment for one year;

1. 특수상해 피고인은 2019. 10. 31. 17:50경 경주시 B에 있는 ‘C’에서, 그날 인력사무소에서 일감을 받지 못해 화가 난다는 이유로 술에 취해 소주방 주인인 D(여, 68세)에게 화풀이를 하던 중 피해자 E(남, 64세)로부터 제지를 당하자 한손으로 피해자의 목 부분을 밀쳐 넘어뜨리고 피해자의 몸 위에 올라탄 후 위험한 물건인 사기 뚝배기(지름 10cm)를 들고 피해자의 머리 부분을 1회 때려 피해자에게 18바늘을 꿰매는 등 치료일수 미상의 두피 부위 열상을 가하였다.

3. 공무집행방해 피고인은 2019. 11. 1. 06:45경 경주시 I 앞에서, ‘피고인이 재차 제2항 기재 사무실을 찾아와 소란 피운다’는 112신고를 받고 출동한 경주경찰서 J파출소 소속 경장 K으로부터 신고 사항에 대한 확인을 요청받았음에도 자신의 바지와 속옷을 내려보이는 등 답변을 거부하고, 재차 위 사무실로 되돌아가려고 하다가 경장 K으로부터 제지당하자 왼 주먹으로 경장 K의 오른쪽 얼굴 부분을 1회 때리고, 이에 경장 K으로부터 제압당하여 그 자리에 누운 상태가 되자 오른발로 경장 K의 왼쪽 얼굴 부위를 1회 찼다.

Accordingly, the defendant received 112 reports and interfered with the legitimate execution of official duties by the police officer dispatched.
