A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
On October 17, 2011, the defendant was called as public interest service personnel and served in the public health clinic in Cheongju-si.
Public duty personnel shall not leave their service or serve in the relevant field for at least eight days in total without justifiable grounds.
Nevertheless, on October 1, 2013, the Defendant directly received “the notice of re-designation of service institutions, etc.” from the Defendant’s office located in Cheongju-si, the Defendant was serving as public interest service personnel at the Cheongju-si, Public Health Center from October 7, 2013 to October 1, 2013, and failed to serve as public interest service personnel at the Cheongju-si, Public Health Center for at least eight days in total without justifiable grounds during the period from October 1, 2013 to October 25, 2013; from October 23, 2013 to October 25, 2013; from October 28, 2013; from November 14, 2013 to November 15, 2013 to November 18, 2013.

The reason for sentencing under Article 89-2 subparag. 1 of the former Military Service Act (amended by Act No. 11849, Jun. 4, 2013) on criminal facts was that the Defendant was sentenced to imprisonment for a violation of the Military Service Act by this court on July 11, 2012, and that the Defendant was sentenced to a two-year suspended sentence for a violation of the same Act, and that he was subject to a two-year suspended sentence for a violation of the same Act on the grounds that he/she faithfully performed his/her duty and reflects himself/herself, it is inevitable to punish him/her significantly in that he/she committed the crime of this case while he/she was
In addition to the above circumstances, the sentencing conditions, such as the defendant's age, character and behavior, career, family relationship, property status, etc., are equally considered and the punishment is determined as ordered.
