A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On January 19, 2012, the Defendant held a meeting with the Si Council members and Gu Council members to strengthen the organization in preparation for the election, and tried to deliver department store merchandise coupons to E president and encourage their activities.

A National Assembly member, local council member, head of a local government, representative of a political party, candidate, and his/her spouse shall not make a contribution to an institution, organization, facility, or any other person, institution, organization, or facility having relations with the electorate even if they are outside the constituency concerned, and no one shall make a contribution for the candidate in connection with the election.

On January 19, 2012, around 15:55, the Defendant: (a) around the GF building in Gwangju, the Defendant issued a gift certificate of KRW 700,000,00 to E president I and J, i.e., a gift certificate of KRW 1,000,00,000, including the issuance of two gift certificates of the department store; and (b) a gift certificate of KRW 700,000,00 in total by issuing one gift certificate of the department store to K.

As a result, the defendant, a local council member, made a contribution to a person in the constituency or a person who has relations with the electorate, and provided a contribution act for C candidate in relation to the election.

2. The Defendant, as shown in the [Attachment 5, 6, and 7] List of Crimes Nos. 5, 6, and 7, issued two copies of merchandise coupons to E L and M, respectively, and expressed to E Chairman N an intention to provide two copies of merchandise coupons.

As a result, the defendant, a local council member, or a person in the constituency or a person who has a relation with the electorate, made a contribution act or expressed his/her intention to make a contribution act.
