A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Criminal facts

1. The Defendant is a person who is engaged in driving a car BK5 vehicle in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused before the risk).

On May 17, 2016, the Defendant driven the said car under the influence of alcohol content of 0.196% among blood transfusions on May 17, 2016, and driven the road of five-lanes in front of the Dobong-gu, Kimhae-si, and proceeded along the two-lanes in front of the yellow School distance, which is located outside the city of Kimhae-si.

At that time, the driving direction of the vehicle was marked on the road along the intersection of a private street, and the defendant was driving along the left-hand turn in order to turn to the left, so there was a duty of care to properly operate the steering gear and the brake system and to safely proceed in accordance with the driving direction of the vehicle.

Nevertheless, the Defendant, while under the influence of alcohol, was unable to drive in a normal way at the right-hand edge of the vehicle of Defendant C (Woo, 26 years old) who was driving in three lanes on the right-hand side of the front side of the road, followed by the left-hand side of the D QM3 passenger vehicle, and received the even part of the Defendant’s car as the front-hand side of the car.

On May 17, 2016, the Defendant, while under the influence of alcohol 0.196% during blood transfusion at around 21:33 on May 17, 2016, driven B K5 cars from the front of the Kimhae-si post office located in the 44th parallel of Kimhae-si to the front road of the salary class in the ewing-si, Kimhae-si.
