1. The defendant's KRW 45,200,00 and its amount shall be 5% per annum from June 16, 2020 to October 16, 2020 to the plaintiff.
Reasons
1. The plaintiff is obligated to pay the defendant the total amount of KRW 45.2 million on November 12, 2003, KRW 5 million on November 28, 2003, KRW 13.6 million on June 13, 2005, KRW 6 million on February 13, 2006, KRW 12.2 million on November 10, 2008, and KRW 5 million on April 13, 2009, respectively. Thus, the defendant is obligated to pay the plaintiff the total amount of KRW 45.2 million and delay damages.
2. Article 208 (3) 3 of the Civil Procedure Act applicable provisions of Acts.
3. The reason for partial dismissal is that the Plaintiff further lent the Defendant a loan of KRW 2.8 million on November 10, 2008, and KRW 7 million on January 23, 2009 (However, the Plaintiff seeks payment of KRW 55 million out of the total amount of the loan claimed). However, the submitted evidence alone is insufficient to acknowledge this.
