Reasons
Punishment of the crime
On April 27, 2012, the Defendant was sentenced to imprisonment with prison labor at the Busan District Court for fraud on January 5, 2012, and the judgment became final and conclusive on March 1, 2013.
The Defendants issued a false tax invoice to pretend that they had sales performance and used it to submit a list of total tax invoices of each recorded company to the tax office.
1. On April 22, 2011, the Defendant conspired with C on April 2, 2011, the Defendant submitted a preliminary return of value-added tax (from February 1, 2011 to March 31, 2011) at the Busan District Tax Office located in 263, as the superintendent of Busan Metropolitan City, Seo-gu, Busan, on April 22, 2011, and submitted a list of total accounts of value-added tax at each supplier information column, in submitting a list of total accounts of value-added tax at each supplier information column, “D Co., Ltd.”, “E,” and “E” on the date of preparation, submitted a false list of accounts of value-added tax, including “12,00,000,000,” and “12,000,000,000 in the supply column.”
2. On July 25, 2011, the Defendant of the final return of January 201, in collusion with C as above, the Defendant filed a final return of value added at the Busan District Tax Office located in 263 as the superintendent of the Seoul Metropolitan City, Seo-gu, Busan, on July 25, 2011 (the transaction period between April 1, 201 and June 30, 201) and submitted a final return of value added tax for the first time in April 1, 2011 (the transaction period between June 1, 201 and June 30, 201), and in submitting a list of the total accounts of value added tax at each selling place, D companies did not provide goods or services to F in the business registration number column, “G”, “F”, “2,” and “19,500,000,000 won” in the supply column, and “6,005,005,000 won” in the attached list of crimes.
