1. The plaintiff's lawsuit against the defendant B and the defendant C, D, and Franchi Mutual Savings Bank.
Reasons
Basic Facts
On July 30, 2001, the Plaintiff completed the registration of initial ownership relating to each real estate (hereinafter each real estate of this case) listed in the table 1 to 359 [Attachment 1] attached hereto.
On January 19, 2002, Defendant E and F completed the principal registration based on the above provisional registration on December 28, 2002, on the provisional registration of ownership transfer claim based on trade reservation with respect to 1/2 of each of the real estates listed in Nos. 358,359.
The Plaintiff entered into a building management service agreement with Defendant B Co., Ltd. (hereinafter “Defendant B”), and completed the provisional registration of the right to claim ownership transfer on each of the real estate listed in the sequence 1 through 357 among the instant real estate in order to secure the service cost to Defendant B on January 24, 2002.
On May 7, 2002, Defendant Franchi Mutual Savings Bank (hereinafter Defendant Franchi Bank) completed the additional registration prior to the claim for transfer of ownership on each of the real estates listed in the Nos. 172 through 357 among the instant real estates on May 7, 2002.
Defendant D completed the additional registration prior to the claim for transfer of ownership, which was based on each of the real estates listed in the No. 1 through No. 171 of June 12, 2002, as to each of the instant real estates listed in the No. 172 through No. 355 of October 30 of the same year, as to each of the real estates listed in the No. 356 and No. 357 of December 28 of the same year.
Defendant D completed the principal registration based on each of the above provisional registrations with respect to each of the immovables listed in the Nos. 48 through 355 of October 30, 2002 among the instant immovables, and with respect to each of the immovables listed in the Nos. 26, 28, 39, 356, and 357 of June 16, 2003.
Defendant C Co., Ltd. (hereinafter Defendant C.) for which Defendant D’s wife was the representative director, on October 30, 2002, was based on a contract for the transfer of rights with respect to each of the real estates listed in the sequence 1 through 25, 27, 29 through 38, and 40 through 47.
