Reasons
Punishment of the crime
"2016 Highest 3267"
1. From around October 17, 2016, the Defendant: (a) was stolen by taking the cash withdrawal 1426 KEB’s main shop in the Seo-gu, Seo-gu, Busan, Seo-gu; (b) on October 17, 2016, with one credit card of KEB bank owned by the victim after cash withdrawal by the victim C; and (c) with one credit card of KEB bank owned by the victim after cash withdrawal by the victim C.
2. Violation of the Act on Financial Business Specializing in credit, and fraud;
A. On October 17, 2016, around 20:55, the Defendant settled food payments and the Defendant paid the amount of meal equivalent to KRW 23,00,00,00, with the meals of the amounting to KRW 23,00,00 in the Gangnam-gu Seoul Metropolitan Government, which was located in the dispute settlement bank, and the credit card bank in the name of the stolen C, as described in paragraph (1) of the above, presented the credit card in the name of the Defendant to an employee who was not the Defendant.
However, the defendant had no intention or ability to pay the price by presenting another person's credit card.
Accordingly, the defendant used stolen credit cards, and at the same time by deceiving the above employee, thereby deceiving the food amounting to KRW 23,00.
B. On October 18, 201, around 201, the Defendant settled the purchase price of the Nowon-gu Seoul Metropolitan Government Nowon-gu’s Da Building 206 “E”, purchased Nowon-gu’s 2,90,000 won at the market price, and then presented the stolen name KEB credit card bank as if it were the Defendant’s ownership to the above store employees F.
However, the defendant had no intention or ability to pay the price by presenting another person's credit card.
Accordingly, the defendant used stolen credit cards and, at the same time, by deceiving Franchisation of the above store staff, acquired another's property.

1. On October 11, 2016, the Defendant: (a) committed theft at a location in the territory of the office of KEB Han Bank located in Gangnam-gu Seoul, Seoul, Seoul, 37, at the 20th office of the KEB Han Bank; and (b) at a location in the cash payment season, one copy of the CPC card, the victim G-owner, was stolen.
