1. The Defendant’s disposition of permission for the development of spring water to A Co., Ltd. on July 31, 2015 is revoked.
2. The costs of the lawsuit are assessed against the defendant.
Reasons
1. Details of the disposition;
A. On August 2012, A Co., Ltd. (hereinafter “A”) filed an application with the Defendant for a provisional permission for the development of spring water in order to conduct the business of manufacturing spring water with the spring water drawn by installing three water pumping stations (hereinafter “water pumping stations in this case”). On December 12, 2012, the Defendant granted a provisional permission for the development of spring water on the condition that A submit an environmental impact survey report to A within two years.
B. On December 6, 2014, A filed an application for permission for the development of spring water with an environmental impact investigation report (hereinafter “instant investigation report”) prepared by C Co., Ltd. (hereinafter “C”) to the Defendant, and the Defendant requested the head of the original regional environmental office to conduct a technical examination of the instant investigation report.
If any excess of water quality standards, sudden change in water level, etc. is discovered as a result of the examination of environmental impacts, the collection of water shall be immediately suspended, and the causes thereof shall be discovered, and countermeasures shall be formulated and implemented
(b) Where any damage occurs to surrounding areas due to a river water level due to continuous water intake, the water intake shall be immediately suspended and a separate measure shall be formulated and implemented against such damage;

The monitoring well shall install and operate a continuous automatic measuring instrument to measure and record “water level of raw water, electric intensity, temperature, hydrogen temperature, etc.” and shall take measures such as recording the results of the observation in a manual when the device is broken.
