The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. At the time of misunderstanding the fact, the Defendant only delivered the plastic bags to the wife upon the request, and did not have any participation with the knowledge that the Defendant was a phishing crime.

Nevertheless, the judgment of the court below which found the defendant guilty is erroneous by mistake of facts.

B. The sentence of the lower court’s unfair sentencing (two years of imprisonment) is too unreasonable.

2. Determination

가. 사실 오인 주장에 대한 판단 원심이 적법하게 조사하여 채택한 증거들에 따라 알 수 있는 다음과 같은 사정, 즉 ① 피고인에게 돈 봉투를 건네준 D은 자신의 범행을 시인하면서 ‘ 위 챗으로 지시하는 공범의 요구에 따라 자신의 모습을 찍은 짧은 동영상을 보내주었다.
