Reasons
1. Details of ruling;
A. Business Name and Public Notice - Business Name - Business Name B Housing Redevelopment Improvement Project (hereinafter referred to as “instant project”): Defendant - Project implementer: The public notice of Dong-gu Busan Metropolitan City on May 19, 2010, the public notice D of Dong-gu Busan Metropolitan City on July 19, 2013, the public notice E of Dong-gu Busan Metropolitan City on September 3, 2014, the public notice of Dong-gu Busan Metropolitan City on December 10, 2014, the public notice of Dong-gu Busan Metropolitan City on June 29, 2016, the G of Dong-gu Busan Metropolitan City on June 29, 2016, the public notice of Dong-gu Busan Metropolitan City on July 13, 2016 - The defendant obtained approval of the first project implementation plan from the head of Dong-gu Busan Metropolitan City (hereinafter referred to as “the first public notice of the project implementation plan”) on May 12, 2010, and the first public notice of the project implementation plan was approved.
Since then, on February 7, 2014, the defendant decided to revise the project implementation plan with the consent of 1,061 members from 1,061 among 1,531 members from the ordinary general meeting, and approved the changed project implementation plan by the head of Dong on August 29, 2014 (hereinafter referred to as "amended project implementation plan" and "authorization of the changed project implementation plan"), and the changed project implementation plan was announced as E public notification of the Busan Metropolitan City Dong-gu Busan Metropolitan City on September 3, 2014, and was authorized on July 20, 2015 after formulating the management and disposal plan.
B. Adjudication on expropriation made on February 20, 2017 by the Busan Metropolitan City Regional Land Expropriation Committee - Date of expropriation: May 4, 2017 - Land subject to expropriation: 152m2 in Busan Dong-gu, Busan Metropolitan City (hereinafter “instant land”) and in the item column of the attached Table 1 (hereinafter “instant obstacles”).
C. The Central Land Tribunal’s appraisal result on November 23, 2017 (hereinafter “the appraisal result of this ruling”) - Compensation for land in this case: KRW 292,212,400.
