위와 같은 공모에 따라 위 성명 불상자는 2017. 4. 27. 10:31 경 불상지에서 피해자 C에게 전화하여 피해자의 아들을 납치한 사실이 없음에도 " 당신 아들이 친구의 빚 보증을 섰는데 돈을 갚지 않아 납치하여 지하실에 가둬 놨으니 아들을 살리고 싶으면 당신이 대신 갚아야 한다, 그렇지 않으면 영영 아들 얼굴을 못 볼 줄 알라" 고 거짓말을 하여 이에 속은 피해자로 하여금 현금 3,280만 원을 인출하여 지정된 장소로 나오도록 하고, 피고 인은 위 성명 불상자의 지시에 따라 2017. 4. 27. 13:28 경 서울 영등포구 버드나루로 160 당산 중학교 정문 앞 노상에서 피해 자로부터 현금 3,280만 원을 교부 받으려 하였으나 피해자의 신고를 받고 출동한 경찰관에게 체포되었다.
