A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around May 26, 2018, the Defendant violated the Act on the Protection of Children and Juveniles against Sexual Abuse (obscenity possession), at the “C” office operated by the Defendant located in Pakistan, the Internet site, accessed the Defendant’s “E” to the Defendant’s ID and stored the Defendant’s computer hard disc by transmitting the Defendant’s “F,” “G,” “H,” “H,” “J,” “K,” and “K,” etc., including the Defendant’s sexual act exposed to the Defendant.
Accordingly, the defendant was aware that he was a child or juvenile pornography.
2. Around June 5, 2018, the Defendant violated the Act on the Protection, etc. of Children and Juveniles against Sexual Abuse (production, distribution, etc. of obscene materials) and the Act on Promotion, etc. of Information and Communications Network Utilization and Communications Network Utilization and Information Protection, Etc. (Distribution of obscene materials) distributed or openly displayed obscene materials for children and juveniles by downloading the same video files stored at the same place as the above 1.
As a result, the Defendant distributed or openly displayed child or juvenile pornography, and at the same time distributed or openly displayed obscene images through information and communications networks.
