A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

그럼에도 불구하고 피고인은 2017. 2. 25. 전주시 완산구 B에 있는 피고인의 주거지에서 주식회사 넥슨이 운영하는 ‘ 서든 어택’ 게임의 클라이언트 데이터를 변조하는 방법으로 상대편의 캐릭터를 볼 수 있고, 상대편의 머리를 공격하여 죽일 수 있으며, 총이 반동을 하지 않아 상대방보다 유리하게 게임을 할 수 있게 해 주는 악성 프로그램과 인증 코드를 대 금 6만 원을 받고 위 게임의 이용자 C에게 전송한 것을 비롯하여 그때부터 2017. 9. 3.까지 별지 범죄 일람표 기재 1 기 재와 같이 모두 800회에 걸쳐 대금 46,392,844원을 받고 위 악성 프로그램을 위 게임의 이용자들에게 전송하였다.

2. No one shall knowingly receive any divulged personal information for profit or any unlawful purpose;

그럼에도 불구하고, 피고인은 2017. 2. 27. 피고인의 주거지에서 위 악성 프로그램을 판매할 목적으로 개인정보 판매상( 네이트 온 닉네임 D)에게 그 대금 15,500원을 지급하고 누설된 개인정보인 주식회사 넥슨의 회원 아이디 및 비밀번호, 생년월일 10건을 그 사정을 알면서 네이트 온을 통하여 전송 받은 것을 비롯하여 그때부터 2017. 7. 24.까지 같은 방법으로 별지 범죄 일람표 2 기 재와 같이 총 70회에 걸쳐 그 대금 3,015,500원을 지급하고 누설된 개인정보 약 2,000건을 전송 받았다.
