A defendant shall be punished by imprisonment for not less than eight months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From March 2, 2020 to B, the Defendant is a business owner who has employed victims C (60 years of age) and performed a new construction work of neighborhood living facilities in B from March 2, 2020, and is a safety and health manager in the construction site.

1. A business owner shall take measures necessary to prevent industrial accidents that may occur in the course of conducting work at a place where workers might fall down at a risk of falling, and in particular, the business owner has a duty of care to prevent accidents by taking safety measures, such as having workers wear a ice string or brate, etc. in order to prevent a sudden move, and having workers wear a protective outfit, safety string, etc.;

Nevertheless, the Defendant did not have the victim get on board the complaint work unit and let the victim perform the management of the C-type lecture on the steel structure with a height of 7.2 meters, but did not have the victim use the A-gout or balke at the complaint work unit or wear the safety belt.

As a result, while the victim was engaged in the above work on June 6, 2020 around 13:11, the victim fells on the ground due to the voluntary movement of the complaint work unit and died on the two alleys at around 14:01 on the same day.

As above, the Defendant caused the death of the victim by occupational negligence, which did not fulfill the duty to take safety measures.

2. The business owner shall take measures necessary for the prevention of industrial accidents which may occur in the course of work at a place where workers might fall down;

In particular, in order to prevent any danger to workers when a business owner engages in work using a vehicle system, loading, unloading, transportation, machinery, etc., he/she shall prepare a work plan which includes the measures to prevent the danger of workers, such as fall, fall, electric power failure, narrowness, collapse, etc., and the operating routes and work methods of loading, unloading, transportation, machinery, etc.
