1. The Defendants jointly share the Plaintiff’s KRW 22,50,000, and KRW 18,000,000 to Plaintiff B, and KRW 7,60,000 to Plaintiff C, and Plaintiff.
Reasons
1. Basic facts
A. Defendant E is a licensed real estate agent operating the G Licensed Real Estate Agent Office located in Pyeongtaek-siF, and Defendant Korea Licensed Real Estate Agent Association (hereinafter “Defendant Association”) concluded a mutual aid agreement with Defendant E to assume responsibility for damages arising from the act of brokerage between Defendant E and the client, within the limit of KRW 100,000,000.
B. The Plaintiffs, as indicated below, concluded a lease agreement for each of the instant units of the instant building from Pyeongtaek-si J on the first ground (hereinafter “instant building”) with the owner H at the time of introduction of Defendant E, and completed the move-in report and the fixed date respectively.
Plaintiff
A fixed date of February 303, 203 and 45,000,000 won from March 20, 2012 to March 19, 2012, the date of concluding the contract, which is the date of the move-in report for the term of lease deposit in the family room, the date of signing the contract, shall be 45,00,000 won from March 16, 2012 to March 403, 2012, and 40,000 won from March 18, 2012 to March 17, 2017, 207.
C. The instant building is a multi-family house consisting of 18 units in total. On August 20, 2013, the procedures for voluntary auction (hereinafter “instant auction procedures”) was initiated in Suwon District Court, Suwon District District Court, K on the application of the Suwon Central Saemaul Depository, which is a mortgagee, and was awarded a successful bid in KRW 600,000 on August 25, 2014 (the appraised value of the instant building was KRW 819,648,360) and on October 14, 2014, KRW 593,982,019, excluding execution expenses, etc. out of the proceeds of sale, was distributed to creditors.
At the time of the voluntary auction, the major lease status of the building of this case is as shown below.
L 202 No. 50,000,000 won for the fixed date of the move-in report for the lease deposit of the name family room, the date of moving-in report for the lease deposit for the name family room, shall be October 11, 201, M 302, 50.
