A defendant shall be punished by imprisonment for two years.

Punishment of the crime

The remainder of the judgment subject to retrial, excluding a final and conclusive judgment of conviction, shall be excluded from that of retrial.

[criminal record] On December 12, 2008, the Defendant was sentenced to four years of imprisonment in Busan District Court’s Dong Branch Branch of the Dong Branch of the District Court (Rape by blood) and completed the execution of the sentence on September 10, 2012.

[Criminal facts] The Defendant, after being released on September 10, 2012, committed an act of gambling and living without a certain occupation after being released from the military court, continuously demanded money to his/her father and his/her motherland as he/she was in need of money at the time of entering the river of the Gangwon-do.

1. Special damage;

A. The Defendant: (a) demanded the Defendant to call to the Victim C (V, 47 years of age) who is the largest of the Defendant; (b) refused the request; (c) rejected the request; (d) found the victim’s house located in Gangwon-gun P on September 3, 2013; and (e) destroyed the victim’s house by breaking two stones, which are dangerous objects the victim’s house located at the same place, and ices, which were located on the front door of the victim’s house and the small door door, and destroying 5 fire extinguishings at the market price of the victim’s house.

B. In around 05:00 on September 28, 2013, the Defendant: (a) caused assault to the victim; (b) obtained a claim from Q, an ASEAN of the victim; and (c) on September 28, 2013, the Defendant destroyed and damaged the walls (23 cm in length), blocks (20 cm in length), and stones, etc., which are dangerous things that were found at the victim’s house, and were collected into the victim’s house at around 06:00, Sept. 28, 2013, the Defendant destroyed and damaged three fire parts in the room, which were located in the victim’s house, in total at the entrance of the victim’s house and at least 170,000 won in the market price, and the market price incombustible portion in the market price.
